1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) and ARK Rising ("we," "us," or "our"), governing your access to and use of arkrising.com, including any tools, calculators (such as Find Your Number), front-office automation services, and marketing services for trades businesses and farms (collectively, the "Services").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you must discontinue use immediately.

2. Services Description

ARK Rising provides the Trades Assistant, the Business Builder, inquiry response workflows, customer communication assistants, and review request automation designed for trades and home services businesses (including HVAC, general contracting, roofing, and landscaping), as well as marketing and communication services for farms and ranches.

Our calculators, including Find Your Number, provide estimates based on information you enter. They are informational tools intended to help prioritize operational improvements and do not guarantee specific financial results or revenue increases.

3. User Representations & Submissions

When submitting information through our calculators, inquiry forms, or communication channels, you represent and warrant that:

• All registration and contact information you submit is true, accurate, current, and complete.
• You have the legal capacity and authority to act on behalf of your business entity.
• You will not use our Services for any illegal, unauthorized, or abusive purpose.

4. Intellectual Property Rights

Unless otherwise indicated, the Services, including source code, website design, text, graphics, and logos, are owned or licensed by ARK Rising and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited license to access and use the Services solely for your own internal business evaluation and authorized operational support.

5. Client Agreements & Engagements

Specific terms governing ongoing implementation, managed front-office assistants, monthly plans, or dedicated consulting are outlined in individual client service agreements executed directly with ARK Rising. In the event of any conflict between these website Terms and an executed client agreement, the executed agreement controls.

6. Limitation of Liability

In no event will ARK Rising, its members, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the website or calculators.
